Terms of use

These terms govern access to and use of Evantya. By creating an account, you accept them.

Last updated: [À COMPLÉTER : date de dernière mise à jour]

Purpose

These terms of use (the “Terms”) set out the rules for accessing and using the Evantya platform, published by [À COMPLÉTER : dénomination sociale de l'éditeur] (“the Publisher”). They apply to anyone who accesses the service, with or without an account (“the User”).

The financial terms applying to paid plans are the subject of separate terms of sale. Where the two conflict, the terms of sale prevail on everything concerning price, invoicing and termination of paid plans.

What the service does

Evantya is a service for putting people in touch and organising events. In particular, it lets:

  • organisers (private individuals or businesses) describe their event, look for vendors, exchange messages with them, receive quotes and track their budget;
  • vendors present their business, manage their catalogue of services, answer enquiries, draw up quotes and hand over their deliverables;
  • everyone use organising tools (countdown, run sheet, guest list, seating plan, playlist, payment tracking).
The Publisher is not a party to the service contracts

Evantya puts organisers and independent vendors in touch with each other. Bookings are agreed and performed directly between them. The Publisher is neither an events vendor, nor an agent, nor a guarantor of the proper performance of those bookings.

Access and sign-up

Access to personalised features requires an account. The User undertakes to provide accurate information and to keep it up to date. The account is strictly personal: the User is responsible for keeping their credentials confidential and for any activity carried out from their account.

Sign-up is reserved for adults and, for a professional account, for a person authorised to bind the organisation they represent.

Accounts and roles

Organiser workspace

For private individuals and businesses organising an event. It gives access to the organising tools and to introductions to listed vendors.

Vendor workspace

For events vendors. The professional declares that they carry on their business lawfully and hold the authorisations, qualifications and insurance required for the services they offer. They alone are responsible for the accuracy of their prices, their availability and the regulatory information they publish, in particular on food hygiene and allergen information.

One account holder may have several workspaces. A workspace’s data is accessible only to its members and, where relevant, to the party with whom an exchange or a contract is under way.

Users’ obligations

The User undertakes to:

  • use the service in accordance with the law and with these Terms;
  • publish no content that is unlawful, misleading, defamatory, hateful, or that infringes the rights of others;
  • not impersonate anyone else or create false reviews;
  • not attempt to access data not intended for them, nor to disrupt the running of the service;
  • not systematically extract or reuse the platform’s content, in particular the vendor directory;
  • respect the rights of the people whose data they import (guests in particular), and make sure they are entitled to process it.

Published content and reviews

The User keeps ownership of the content they publish (texts, photographs, documents). They grant the Publisher a non-exclusive, royalty-free licence to use that content, limited to what is needed to run and promote the service, for as long as it is used and until it is deleted.

Reviews must be based on a real experience. The Publisher may take down a review that is manifestly false, abusive, unrelated to the booking, or published in exchange for an undeclared benefit. The vendor concerned has a right of reply.

Any manifestly unlawful content may be reported to oren@wedevops.fr. The Publisher acts promptly to take it down once it has actual knowledge of it.

Intellectual property

The platform, its visual identity, its texts, its databases and its developments are protected and remain the property of the Publisher or its licensors. No reproduction, adaptation or reuse, in whole or in part, is permitted without prior written agreement, beyond normal use of the service.

Availability and maintenance

The Publisher takes reasonable steps to keep the service available, with no guarantee of uninterrupted operation. Interruptions may occur for maintenance, updates, or because of third parties (host, network). Planned interruptions are announced where possible.

Assisted features

Some features offer drafts or summaries generated automatically (a suggested quote, a draft reply, an event summary). These are suggestions: they must be read and approved by the User, who remains solely responsible for what they send, publish or sign. No external action is triggered without human approval, and no fully automated decision producing legal effects is taken.

Liability

The Publisher is responsible for the proper running of the service it provides. It cannot, however, be held liable:

  • for the performance, the quality or the price of the services agreed between an organiser and a vendor;
  • for the accuracy of the information published by users;
  • for the consequences of improper use of the service or of a loss of credentials attributable to the User;
  • for indirect loss, such as a loss of revenue, of custom or of data not attributable to the Publisher.

Nothing here limits the Publisher’s liability in the event of gross negligence or wilful misconduct, of personal injury, or in any case where the law forbids it — in particular towards consumers.

Suspension and termination

The User may stop using the service and ask for their account to be deleted at any time from their settings or by writing to oren@wedevops.fr.

The Publisher may suspend or close an account in the event of a serious breach of these Terms, after a formal notice left unanswered for fifteen (15) days, except for a serious or unlawful breach warranting immediate suspension. Data is then kept or deleted according to the periods set out in the privacy policy.

Changes to these terms

These Terms may change. Any substantial change is notified to Users holding an account at least thirty (30) days before it takes effect. Continuing to use the service counts as acceptance; failing that, the User may close their account at no cost.

Governing law and disputes

These Terms are governed by French law. Should any difficulty arise, the User is invited to contact the Publisher in order to seek an amicable solution.

In accordance with articles L. 611-1 and following of the French consumer code, a consumer may refer the matter free of charge to a consumer ombudsman: [À COMPLÉTER : médiateur de la consommation (nom et coordonnées)]. The European online dispute resolution platform is also available at [À COMPLÉTER : lien vers la plateforme de règlement en ligne].

Failing an amicable agreement, the dispute is brought before the competent courts. A consumer keeps the right to bring proceedings before the court of their place of residence.
