Terms of sale

Terms of sale

The terms applying to Evantya’s paid plans: what you buy, at what price, and how to end it.

Last updated: [À COMPLÉTER : date de dernière mise à jour]

Purpose and scope

These terms of sale (the “Terms of Sale”) govern the sale of Evantya’s paid plans, published by [À COMPLÉTER : dénomination sociale de l'éditeur] (“the Publisher”). They supplement the terms of use, which remain applicable. Where the two conflict on a financial point, these Terms of Sale prevail.

They apply to professionals and consumers alike. The provisions expressly reserved for consumers — the right of withdrawal in particular — benefit only natural persons acting for non-professional purposes.

Paid plans and features

Vendor subscription

Reserved for events professionals, it gives access to visibility in the directory and to the management tools (service catalogue, quotes, contracts, deliverables, financial tracking). The detail of the tiers and their limits is on the pricing page, which forms an integral part of these Terms of Sale.

Paid services for organisers

Organising an event, searching for vendors, messaging and the tracking tools are free for organisers. Only certain advanced features are paid for; they are identified as such in the interface before any commitment, with their price shown.

The Publisher takes no commission on the bookings agreed between an organiser and a vendor, unless expressly stated otherwise in the plan subscribed to.

Prices and taxes

Prices are given in euros. For consumers they are shown including all taxes; for professionals, excluding tax, with the applicable VAT added at the rate in force on the invoicing date.

The Publisher may change its prices. Any change is notified at least thirty (30) days before it takes effect and applies only from the next billing period. A customer who refuses the new pricing may terminate at no cost before it takes effect.

Subscribing

Subscribing is done online from an Evantya account. The customer selects their plan, checks the summary (contents, price, term, date of the first payment), then confirms their order. Confirmation counts as acceptance of these Terms of Sale and forms the contract.

A summary is sent by email. The customer makes sure the billing information they provide is accurate.

Payment and invoicing

Online payment not yet switched on

At the date these Terms of Sale were published, online payment is not yet switched on on Evantya: the platform can take no money at all. The invoicing features are visible as preparation, with no real collection. The chosen payment provider ([À COMPLÉTER : prestataire de paiement]) and the corresponding arrangements will be set out here when it is switched on, which customers will be told about beforehand.

Once it is switched on, payment will be made by the means offered in the interface, through an accredited payment provider. The Publisher will never have access to full card details, which that provider alone holds.

An invoice is made available in the customer area for each instalment. Between professionals, any late payment automatically incurs interest at the enhanced statutory rate, together with a flat recovery fee of forty (40) euros, in accordance with article L. 441-10 of the French commercial code.

Right of withdrawal

A consumer has fourteen (14) days from the conclusion of the contract to withdraw, without having to give a reason or bear any penalty, in accordance with article L. 221-18 of the French consumer code.

To exercise it, simply send an unambiguous statement to oren@wedevops.fr before the deadline. The refund is made within fourteen (14) days of receiving the request at the latest, using the same payment method as the order.

Waiver where the service starts immediately

If the customer expressly asks for the service to start before the withdrawal period ends, they acknowledge that they will lose their right of withdrawal once the service has been fully performed. If they withdraw before full performance, they still owe an amount proportionate to the service already provided (article L. 221-25 of the French consumer code). That request is collected explicitly at the moment of subscribing.

The right of withdrawal does not benefit professionals subscribing for the purposes of their business, subject to the statutory exceptions.

Term, renewal and termination

The subscription is taken out for the term stated at the time of order (monthly or annual) and renews automatically for the same term, unless terminated.

Termination is done from the customer area, at any time and at no cost. It takes effect at the end of the current period: the service stays available until that date and no further instalment is taken. In accordance with article L. 215-1 of the French consumer code, a consumer is told the deadline for non-renewal at the latest one month beforehand.

The Publisher may terminate in the event of a serious breach or persistent non-payment, after a formal notice left unanswered for fifteen (15) days.

Refunds

Other than where the right of withdrawal is exercised, sums covering a period already started are not refunded, the service having been provided. A pro-rata refund is nonetheless granted where the service is unavailable for a prolonged period through the Publisher’s fault, or where an essential feature of the plan subscribed to is withdrawn.

Obligations of the parties

The Publisher undertakes to provide the service as described in the plan, to keep the customer’s data confidential and to tell them of any substantial change. It remains bound by the statutory guarantee of conformity and by the guarantee against hidden defects on the terms provided by law.

The customer undertakes to pay the agreed price, to use the service in accordance with the terms of use, and to keep their billing information up to date.

Complaints and disputes

Any complaint may be sent to oren@wedevops.fr. The Publisher undertakes to acknowledge receipt within five (5) working days and to give a reasoned answer within a reasonable time.

A consumer may refer the matter free of charge to a consumer ombudsman: [À COMPLÉTER : médiateur de la consommation (nom et coordonnées)]. These Terms of Sale are governed by French law. Failing an amicable agreement, the dispute is brought before the competent courts, a consumer keeping the right to bring proceedings before the court of their place of residence.
